Amendment to IRC Section 162 - What are your thoughts?


Confidentiality agreements have become a renewed focal point of discussions among employment mediators. Will neutrals have a more difficult task resolving sexual harassment/abuse claims under the amendment to IRC Section 162 which now bars tax deductions for operating expenses for settlements subject to nondisclosure agreements?

Provided that advance disclosure of this possibility is made to the parties, should an arbitration provider assist or represent the party that has prevailed in an arbitration with obtaining confirmation of the arbitration award, where the provider giving such assistance administered the underlying arbitration?

Arbitrator Cancellation Fees - What are your thoughts?


Should arbitrators have cancellation fees? If yes, consider:

(i) What is a reasonable time period for parties to incur the cancellation fee?

(ii) If the parties reach settlement on a matter within the cancellation period and have several weeks of hearings scheduled, should an arbitrator bill for all hearing dates scheduled?
