Uninsured Motorist Arbitration - What are your thoughts?

In an uninsured motorist arbitration, should the Arbitrator grant an Order to preclude the insurance company from disclosing the amount of the insurance available to the Arbitrator?

You should follow the law of the State where the suit would be filed if there was no arbitration.

The arbitrator should decline to sign such order. There is no reason why the arbitrator should be denied the insurance information. Unlike a jury,the arbitrator should know whatever the parties know and can be expected to use the information appropriately.

Barry Evenchick:

I would not grant such Order. I believe arbitrators should have the same information as the parties to the litigation. Unlike juries, arbitrators generally can be relied upon to utilize the insurance information prudently and correctly.
