October Poll Question

Our July/August issue featured Ronald Offenkrantz’s skeptical take on the utility, speed and cost-effectiveness of arbitration in complex commercial cases. Edna Sussman answers in this issue, pointing out that arbitration can be the best route particularly for companies that need to maintain productive business relations. What has your experience been?

BOB HELM:

Because a large part of the high cost of arbitration in the Offenkrantz article related to the Arbitrator'd hourly fee and apparent lack of control over hours billed by the arbitrator, it would have been helpful if the Sussman article explained how these fees/costs can be controlled.
