NYSDEC Proposes Major Revisions to PBS/CBS Regulations

The NYSDEC (DEC) is seeking informal public comments on draft revised Petroleum Bulk Storage (PBS) and Chemical Bulk Storage (CBS) regulations. This is the first major revision of many of these regulations since 1994. The revised draft regulations address the handling and storage of both petroleum and hazardous substances to conform to changes in state and federal laws. As the first phase of a two-phase rule making process, DEC will receive informal public comments on these drafts between August 1 and September 20, 2013 as described below.

Phase II will occur once the U.S. Environmental Protection Agency (USEPA) finalizes their rule making process currently underway to revise the federal regulations governing the storage of petroleum and hazardous substances in underground storage tanks (Title 40 of the Code of Federal Regulations, Parts 280-281). An additional formal comment period is anticipated in the 2013-2014 Fall-Winter period.
