Issue was raised regarding Section 352 as it appears in the case booklet. The following is clarification regarding this point.
The indictment charges Shawn with violations of GBL 352-c(6) ONLY. The other subdivisions were included to give the students an opportunity to see what a statute looks like. The prosecution is bound by the indictment and should not reference the other subdivisions.
